MEMORANDUM OPINION
MOTLEY, District Judge.
Plaintiff Michael L. Agee (“Agee”) originally brought this action under the Copyright Act, 17 U.S.C. sec. 101, et seq., alleging that defendants had infringed his sound recording copyrights in two Laurel & Hardy musical recordings. On June 3, 1994, this court granted defendants’ motion to dismiss plaintiffs Lanham Act and unfair competition claims and granted defendants’ motion for summary judgment on plaintiffs Copyright Act claim. 1 Plaintiff appealed this determination, and on June 26, 1995, the Second Circuit affirmed in part and reversed in part.…
