CARDAMONE, Circuit Judge:
Plaintiff Michael L. Agee appeals from a July 27, 1995 judgment of the United States District Court for the Southern District of New York (Constance Baker Motley, Judge) granting defendants’ motion to award attorneys’ fees and costs jointly and severally against plaintiff and his attorney, John Walshe, Esq. We hold that this appeal is moot as to Agee in light of his settlement with defendants. Moreover, our exercise of jurisdiction over his attorney John Walshe’s appeal is precluded by Walshe’s failure to file a notice of appeal on his own behalf as required by…
