Appeal from District Court, Shelby County; James I. Perkins, Judge. Action by Charles Howard, by next friend, etc., against the Waterman Lumber & Supply Company and another. From a judgment on a directed verdict for defendants, plaintiff appeals.

Charles Howard, a minor, by his father as next friend, brought this suit against the Waterman Lumber & Supply Company and the Texas & Gulf Railway Company for damages for personal injuries alleged to have been sustained by him. Plaintiff afterwards dismissed his suit against the Railway Company, leaving the Lumber & Supply Company as sole defendant. The case was tried by the court with the assistance of a jury; and after all the testimony had been introduced the court instructed the jury to return a verdict for the defendant, which was done, and thereupon a judgment was entered in defendant’s…
