HALL, Justice:

This case arises from an appeal to this Court by Jacob J. Lamorie (hereinafter defendant), from a conviction for possession of a dangerous weapon while on parole for a felony, in violation of Utah law.1

On the afternoon of October 14, 1978, Jesse Powell, a trooper with the Utah Highway Patrol, was driving westward on U.S. Highway 6 between Crescent Junction and Green River, Utah. Trooper Powell was off duty, and was taking a truckload of boy scouts back to Green River from a scout camp.
