This matter is before the court on a motion to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6) filed by the defendants (collectively, “the EPA”), and motions for a temporary restraining order, preliminary injunction and summary judgment filed by the plaintiff (“SCA”). A hearing was held on all motions on April 10, 1986. For the following reasons, the motions for temporary restraining order and preliminary injunction will be denied as moot.
