The case comes before the court on the defendants’ motion for summary judgment (Dk.34) and the plaintiffs motion for summary judgment (Dk.36). The plaintiff Wanda Arocho brings this action to recover benefits claimed under an Optional Contributory Life Insurance Plan (“Optional Plan”) offered to her husband, Hector Aro-cho, as an employee of the defendant Goodyear Tire & Rubber Company (“Goodyear”).
