MEMORANDUM

SWINFORD, District Judge.

This action was commenced by Kentucky prisoners incarcerated following convictions of willful murder. In each instance, the death penalty originally imposed was commuted by former Governor Ned Breathitt to life imprison ment without parole. Kentucky Constitution Section 77.
