DEVER, District Judge.

Robert Whitesell (“Whitesell” or “plaintiff’) brought this 42 U.S.C. § 1983 action against his former employer, the Town of Morrisville (“town”), and against the town manager, John Whitson (“Whitson”), individually and in his official capacity. Whitesell alleges that he was terminated in violation of the due process clause of the Fourteenth Amendment, Article I, Section 19 of the North Carolina Constitution, and the disciplinary policy within the Town of Morrisville Personnel Policy (“Personnel Policy”).
