INTRODUCTION

On February 6, 1991, a grand jury returned a two-count indictment against Richard Rose McElrath (“McElrath”) and Tyawanda Renee Anderson (“Anderson”). Count I of the indictment charges McEl-rath with being a felon in possession of a firearm in violation of 18 U.S.C. § 922(g). Count II charges McElrath and Anderson with conspiring to possess with intent to distribute sixteen grams or more of crack cocaine in violation of 21 U.S.C. § 846.
