The defendant, James Free, brings this appeal from the dismissal of his second post-conviction petition. In 1979 the defendant was convicted in a jury trial in the circuit court of Du Page County on one count each of murder and attempted murder and on two counts of attempted rape. The jury sentenced the defendant to death for the murder conviction, and the trial judge imposed terms of imprisonment for the other offenses.
