The plaintiffs, Maine Beer & Wine Wholesalers Association, Inc., Maine Soft Drink Association and Farmington Coca-Cola Bottling and Distributing Co. (hereinafter the industry), appeal from a summary judgment in favor of the defendant, the State of Maine, entered in the Superior Court (Kennebec County, Alexander, J.) on their complaints against the State for declaratory and injunctive relief. 1 They contend that the court erred in determining, as a matter of law, that the amended beverage container deposit statute, 32 M.R.S.A. § 1866-A (Supp.1992), does not effect a taking of…
