'THE COURT.
Appellant was-charged by the information with the offense of having willfully and feloniously broken and injured a public jail, and also with having suffered a prior conviction of the crime of robbery. To the present charge he pleaded not guilty, and to the charge of a former conviction he pleaded “guilty.” The jury returned a verdict of guilty, and the court imposed the punishment of imprisonment in the state prison for the term of eight years, and he appeals from the judgment and from an order denying his motion for a new trial.
