The defendant herein has been indicted by the Grand Jury of the County of Ulster in a six-count indictment. First and second counts of the indictment accuse the defendant, David Vercelletto, with vehicular manslaughter in the second degree *41in violation of Penal Law § 125.12. Each of the first two counts accuses the defendant of criminal negligence causing the death of Samantha Banks by operating a motor vehicle while intoxicated.
