The State Personnel Board (Board) and the Department of Corrections (DOC) challenge the court of appeals’ order dismissing without prejudice DOC’s appeal of the Board’s order awarding attorney fees against it. 1 See Toothaker v. Department of Corrections, No. 97CA1970 (Colo.App. Mar. 19, 1998) (order partially dismissing appeal without prejudice). The court of appeals determined sua sponte that it lacked jurisdiction over the attorney fee issue because the Board had not yet determined the amount of the award.
