This is an appeal from an order of the superior court of Los Angeles County setting aside a judgment. The action in which the judgment was entered was brought to recover upon a promissory note executed by defendant Fundenberg and indorsed by the other defendants. As set out in the complaint the note was for three thousand dollars principal, with six per cent interest, and contained a provision that “in case suit is instituted to collect this note, or any portion thereof, I promise to pay such additional sum as the court may adjudge reasonable as attorney’s fees in said suit,” and it was…
