This appeal concerns issues arising from an alleged breach of contract to make a will.
On October 10, 1969, John Savage and his wife Emily executed a separation agreement. Under that agreement, John Savage promised to bequeath to a trust for the benefit of the Savage children either the agreed extant value of his law practice, or the law practice itself.1 The parties *825agreed that the current worth of the law practice was $42,000.
