OPINION

FRYE, District Judge:

Plaintiffs in this action are the Oregon Association of Hospitals (OAH), a nonprofit corporation representing member hospitals in the State of Oregon, Portland Adventist Medical Center, Inc. (Portland Adventist), and St. Charles Medical Center (St. Charles).

Defendant, Otis R. Bowen, Secretary of the United States Department of Health and Human Services (HHS), heads the federal agency charged with the administration of the Medicare program established by Congress under the Social Security Act of 1966, 42 U.S.C. § 405(g) (the Act).
