On April 20, 1922, the Kaskaskia Live Stock Insurance Company issued a policy of insurance to appellee for the sum of $750 on a race horse, named “Brondy.” The horse died July 9, 1922, and an action in assump- - sit was instituted by appellee against appellant in the circuit court of Franklin county to recover on said policy.
