—Judgment, Supreme Court, Bronx County (Phylis Skloot Bamberger, J.) rendered October 14,1993, convicting defendant, after a nonjury trial, of rape in the first and third degrees and sodomy in the first and third degrees, and sentencing him, as a second violent felony offender, to concurrent terms of 6 to 12 years on each first-degree conviction and 2 to 4 years on each third-degree conviction, unanimously affirmed.

Defendant’s challenge to the legal sufficiency of the evidence is unpreserved as a matter of law (People v Gray, 86 NY2d 10), and in any event without merit. Defendant also failed…
