Appeal by the defendants, John Wanamaker and others, doing business under the firm name and style of John Wanamaker, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of FTew York on the 6th day -of May, 1903, upon the verdict of a jury for $1,000, and also from an order entered in said clerk’s office on the 15th day of May, 1903, denying the defendants’ motion for a new trial made upon the minutes.

In this case the plaintiff. alleges two causes of action. The first is based upon an alleged assault on the plaintiff by the defendants through one of their duly authorized agents on a public street, in the city of New York, where she was unlawfully forced and dragged and compelled to go to the store of the defendants, and where she was imprisoned and placed in close confinement and restrained of her liberty, and was treated with insult, brutality, contempt and indignity to her person by the duly authorized agent and servants of the defendants, who charged the plaintiff with…
