Defendant, Michael W. Powell, appeals from convictions and consecutive seven year sentences on counts of Burglary in the Second degree and Stealing over $150.00.

Appellant was tried jointly with a co-defendant, Mikel Leon Franks, charged with the same offenses. A co-defendant, Marcus Dale Branch, had previously pled guilty and had testified at the defendant’s preliminary hearing. At that time Branch fully implicated defendant in the commission of the crimes. However, when called by the State to testify at appellant’s trial, Branch refused to answer on the grounds…
