Appeal by the defendant from a judgment of the Supreme Court, Kings County (Deeley, J.), rendered August 12, 1980, convicting him of criminal sale of a controlled substance in the third degree (two counts), upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
On the first day of his trial, the defendant failed to return to the courtroom following luncheon recess. His trial and sentencing were thus held in absentia. In 1983 the defendant was returned to the jurisdiction. It was discovered, however, that in the intervening three years, the trial stenographer had died…
