Prior to his first murder trial, Gregory Mung Sen Tu, the petitioner, moved to suppress certain items of physical evidence seized, pursuant to a search and seizure warrant, from his Las Vegas motel room. A hearing was held on the motion, during the course of which the State proffered as to the items seized and the location from which they were seized. The petitioner characterizes the proffer as a stipulation.1 I agree with that characterization.
