This action is, in effect, one for money had and received. It is brought by tbe plaintiff, Bertba Janzen, upon tbe claim that tbe defendant lias received a certain sum of money for tbe use and benefit of one C. N. Janzen, which sum tbe defendant has refused to pay. Tbe plaintiff brings this action in her own name, as tbe assignee of tbe said C. N. Janzen.

To tbe original complaint, the defendant interposed a demurrer, specifying as ground therefor that tbe complaint did not state facts sufficient to constitute a cause of action. Tbe demurrer was sustained *545by the court, with…
