Perhaps the best way to approach the problem presented by this case is to first examine the former so-called gasoline tax diversion suits (State ex rel. Fdwards v. Osborne, 193 S. C., 158, 7 S. E. (2d), 526, and idem., 195 S. C., 295, 11 S. E. (2d), 260) for they involved vitally different facts and are not at all controlling of the instant issues.
