I. INTRODUCTION
Plaintiff United National Insurance Company (“United National”) moves for summary judgment on its claim for reimbursement of funds it expended in the settlement of a state court action (“the Ortiz action”) brought against Defendant Waterfront New York Realty Corporation (“Waterfront”) and The Tunnel, a discotheque and Waterfront’s tenant.
