PRENDERGAST, Presiding Judge.

Appellant was convicted of murder, and his punishment assessed at five years confinement in the penitentiary.

This is the second appeal. The first is reported in 74 Texas Crim. Rep., 505, 169 S. W. Rep., 299. A sufficient statement was there made, so that the questions now decided can be understood. If any additional statement on any question becomes necessary, we will malee it.
