Appellant was convicted in the District Court of Cherokee County of the offense of murder and the punishment assessed was a term of eleven years imprisonment. Appellant was tried under this same indictment in January, 1912, and was convicted of murder in the second degree and punishment assessed at ten years confinement, but that conviction was set aside in the lower court.
