This is the second appeal of this case. The opinion of the Supreme Court in the first appeal is reported under the title of Monfort v. Indianapolis, etc., Traction Co. (1920), 189 Ind. 683, 128 N. E. 842.

The only error presented in this appeal is the action of the court in overruling appellant’s motion for a new trial.
