OPINION OF THE COURT

Order dated May 25, 1978 (S. Rosen, J.) is affirmed, with $10 costs.

This action proceeded before Trial Term upon an agreed statements of facts, to wit: On March 17, 1974 at or about 1:00 a.m. the plaintiffs were passengers in an uninsured motor vehicle which was in collision with an insured motor vehicle owned and operated by the defendant. At issue is whether the passengers in the uninsured vehicle are required to comply with the threshold issue or serious injury provisions of article 18 of the Insurance Law in order to maintain an action against the owner and/or operator…
