The defendant has appealed from the judg: ment in favor of plaintiff, and from an order denying her motion to set aside said judgment on the ground that it was taken against her by surprise, inadvertence, and excusable neglect.

The action is maintained by Binford as assignee of the Dutro-Wren Construction Company, a corporation. The object of the action was to recover $775, claimed to have been owing to the plaintiff’s assignor for the preparation of certain plans and specifications for the construction of a building to be erected for the defendant and certain other parties who were made…
