Appellant, Alexander Kapuscinski, brought this action in the Eastern District of Michigan to recover pension benefits allegedly withheld in violation of Michigan law and the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1001 et seq. Appellant was employed by General Motors Corporation (GM) from 1936 until February 27, 1972, when he broke seniority and retired.
