Petitioner, The American Ship Building Company (“AmShip”), seeks review of a Benefits Review Board (“Board”) order reversing an administrative law judge’s order that the special fund, 1 created by the Long-shore and Harbor Workers’ Compensation Act, ch. 509, 44 Stat. 1424 (codified as amended in 33 U.S.C. §§ 901-945, 947-950) (1927) (“LHWCA”), reimburse AmShip for “second injury” benefits paid to its employee, Samuel C.
