Petitioner Paducah Marine Ways (“PMW”) seeks review of the decision of the Benefits Review Board of the United States Department of Labor (the “Board”) that claimant Maurice Thompson timely filed his claim for benefits under the Longshore and Harbor Workers’ Compensation Act (the “LHWCA”), 33 U.S.C. §§ 901-950. PMW argues that Thompson’s claim was barred by the one-year statute of limitations for LHWCA benefit claims contained in 33 U.S.C. § 913(a).
