This is an original proceeding in habeas corpus. The petitioner was bound over by an examining magistrate of Ellis county to answer in the district court of that county for the offense of issuing a check on a bank in which he had no funds. The preliminary examination disclosed the following facts: In December, 1924, the petitioner, who was engaged in business at Satanta, in Haskell county, purchased a carload of apples from Messrs.
