OPINION AND ORDER
CONNER, Senior District Judge.
In this diversity action, plaintiff Eastern Refractories Company, Inc. (“Eastern”) asserts a claim for contribution against defendant Forty Eight Insulations, Inc. (“FEI”). Defendant moves, pursuant to Fed.R.Civ.P. 12(b)(5), to dismiss Eastern’s amended complaint for failure to serve the summons and amended complaint within the time period prescribed by Fed.R.Civ.P. 4(m).
