Action brought in the municipal court of St. Paul, to recover $442.67 and interest on a fire-insurance policy issued by defendant. Appeal by plaintiffs from an order refusing a new trial after verdict directed for defendant.

Accepting as true everything which the evidence tended to prove favorable to the plaintiffs, the facts in this case were as follows: Prince & Shandrew were the general agents in St. Paul of the defendant as well as of several other insurance companies. One Jules Jacobson was an insurance broker, who solicited insurance and took the applications of persons desiring insurance to the agents of the company in which it was desired to place it, and, if the application was accepted, obtained the policy, delivered it to the insured, collected the premium, and paid it over to the *472company’s agents, who…
