This case was brought by appellee, ‘ David W. Stevick, in the circuit court of Champaign county against Frank B. Vennum, the appellant, to recover damages alleged to have been sustained by appellee as the result of an involuntary bankruptcy proceeding which the appellant instituted against him. The declaration alleges that the appellee for a period of five years prior to the bankruptcy proceeding had been solvent, and that he was the owner of real and personal property of the value of $200,000 over and above his incumbrances…
