Mary Lee Morgan, widow of Harley Morgan, brought this suit against Tennessee Central Railway Company to recover damages for the death of her husband.

She alleged in the first count of her declaration:

“The defendants own and operate railroads and do so within the corporate limits of the City of Nashville, Davidson County, Tennessee. As a part of said railroad operations, defendants operate and maintain a railroad track which runs approximately east and west, crossing both Fourth Avenue, North, and Fifth Avenue, North, at a point between Harrison Street and Jackson Street, and which said track…
