Plaintiff-appellant Trustees (the “Trustees”) of the Local 138 Pension Trust Fund (the “Fund”) appeal from a decision of the United States District Court for the Southern District of New York (Lewis A. Kaplan, Judge) granting summary judgment in favor of defendant-appellee F.W. Honerkamp Co. (“Honerkamp”) and denying the Trustees’ cross-motion for summary judgment.
