On August 14, 1969, defendant Gary Hart, an appellant herein, drove an automobile off the paved portion of Stanfield Road, Miami County, Ohio, causing sérious injuries to the plaintiff, Randy Whitacre, an occupant of the vehicle. Gary and Randy were classmates, and both were members of the band at Milton-Union High School. At the time of the accident, they were on their way to the high school, having participated earlier in a band concert at the Miami Connty Fairgrounds in Troy, Ohio.
