Plaintiff in error sued in the court below upon a promissory note executed by the defendants Womack and Gilmore, further alleging that the money represented by said note was loaned to the defendants Womack and Gilmore at the special instance and request of defendant Farmers’ & Merchants’ National Bank of Roff, and that said bank, by and through its cashier, F. E.
