Plaintiff brings this action against defendant alleging violations of the Americans *1231with Disabilities Act (ADA), 42 .U.S.C. § 12101 et seq. This matter comes before the court on defendant’s Motion to Dismiss (Doc. 17), pursuant to Fed.R.Civ.E. 12(b)(6), (1) all of plaintiffs claims for punitive damages requested in the complaint and (2) plaintiffs claim for compensatory damages requested in Count II of the complaint.
