Appeal by the defendant, Michael Smith, from a judgment of the County Court of Albany county rendered against him on the 31st day of March, 1910, affirming a judgment of the Police Court of the city of Albany convicting the defendant of being a disorderly person.

The defendant has been convicted of being a disorderly person, under section 899 of the Code of Criminal Procedure, after having *362failed to -give a bond for $700 ti.pon the order of the police justice of the City of Albany, made pursuant to section 901 of said Code. The evidence upon which the conviction rests is that of the complainant alone.
