Appeal by the defendant, Emanuel Demos, from an order of the Court of General Sessions of the Peace in and for the city and county of Hew York, bearing date the 15th day of January, 1906, and entered in the office of the clerk of said court, affirming a judgment of the'City Magistrate’s Court of the city of Hew York, convicting the defendant of being a disorderly person in having abandoned Ms wife and leaving her in danger of becoming a burden upon the public.

Houghton, J.:
The defendant was convicted in a Magistrate’s Court of being a disorderly person in having actually abandoned his wife without adequate support, thereby rendering her liable to become a burden upon the public; and that conviction was affirmed by the Court of General Sessions of the Peace of the city and county of Hew York.
The conviction was had under the provisions of sections 685. and 686 of the Greater Hew York charter (Laws of 1897, chap. 378, as amd. by Laws of 1901, chap. 466), which provide that every person in such city who ■ actually abandons his wife or children without…
