The defendant is charged with being a “ disorderly person,” in that he has failed “ to provide for his wife and two children according to his means.”
The evidence shows that for about eight weeks prior to the date of the information the defendant has contributed fifteen dollars a week to the support of his wife and two children, and thirteen dollars and fifty cents per week for some four months prior thereto; that his weekly earnings during this period approximated fifty dollars per week; that about four years ago a separation agreement was entered into between him and his wife; that since…
