Defendant-appellant, Consolidated Rail Corporation (“Conrail”), appeals from a judgment entered in the Union County Court of Common Pleas, awarding damages for wrongful death to plaintiff Ada Garrett, administrator of the estate of Bernard Garrett, and damages for personal injury to plaintiffs Thomas Gollihue and Cynthia Gollihue. Initially Garrett’s wrongful death claim was filed separately from the Gollihues’ personal injury case, but the cases were consolidated by the Union County Court of Common Pleas for purposes of trial.
