Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, while an inmate at Sullivan Correctional Facility in Sullivan County, was charged in a misbehavior report with violating various prison disciplinary rules arising out of an argument with a fellow inmate and his subsequent failure to obey an order of and his assault upon a correction officer.
