Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner was charged in a misbehavior report with violating various prison disciplinary rules after a strip search resulted in the discovery of a two-inch razor weapon. Petitioner pleaded guilty to interference, refusing a direct order and refusing frisk procedures and, after a tier III hearing, was found guilty of possessing a weapon. The determination…
