The first issue in this case is whether the plaintiff has met the burden of proof to show actionable negligence, in respect to control and management and in operating the automobile on the left half of the highway, on the part of the defendant.
Defendant’s testimony is substantially as follows: He was driving westerly at about thirty-five miles per hour with the right wheels of his car about one and one-half to two feet from the north edge of the black-top.
